These Terms of Service ("Terms") govern your use of the mobile game ("the Game") published by Cheeky Giants ("we", "us", "our"), an independent game studio based in Spain. By downloading, accessing, or playing the Game, you agree to these Terms. If you do not agree, do not use the Game.
These Terms work together with our Privacy Policy, which explains how we handle your data.
The Game is not directed to children under 13 (or the minimum age of digital consent in your country, if higher). By using the Game you confirm you meet that minimum age. If you are a minor in your jurisdiction, you may use the Game only with the consent and supervision of a parent or legal guardian, who accepts these Terms on your behalf.
The Game creates an anonymous account to save your progress, and lets you optionally link a Google Play Games identity to sign in across devices and use social features. You are responsible for activity that occurs through your account and device. Cloud save data is provided to help you keep your progress, but we do not guarantee that progress can always be recovered.
We grant you a personal, limited, non-exclusive, non-transferable, revocable licence to install and use the Game for your own non-commercial entertainment, subject to these Terms and to the rules of the platform store you downloaded it from. We reserve all rights not expressly granted.
The Game shows optional rewarded ads that you choose to watch in exchange for in-game rewards. Advertising and your related choices (including consent in the EEA and the UK) are described in our Privacy Policy.
You agree not to:
If you choose a display name, referral code, or similar content, you must not use anything unlawful, offensive, misleading, or infringing on others' rights. You grant us a licence to use such content as needed to operate the Game (for example, showing your display name on leaderboards). We may remove or change content that breaches these Terms.
We may update, change, suspend, or discontinue the Game or any of its features at any time, including for maintenance, security, legal, or business reasons. We do not guarantee uninterrupted availability. The Game may require updates to keep working.
You may stop using the Game at any time. We may suspend or terminate your access if you breach these Terms, misuse the Game, or where required by law. You may delete your account and associated cloud data from within the Game (Settings). Sections that by their nature should survive termination (such as licences, disclaimers, and limitations of liability) will continue to apply.
The Game, including its code, art, audio, characters, and trademarks, is owned by Cheeky Giants or its licensors and is protected by intellectual property laws. These Terms do not transfer any ownership to you.
The Game is provided "as is" and "as available", without warranties of any kind to the fullest extent permitted by law. We do not warrant that the Game will be error-free, secure, or uninterrupted, or that progress or Virtual Items will always be preserved. Nothing in these Terms excludes rights that cannot be excluded under applicable consumer law.
To the fullest extent permitted by law, we are not liable for indirect, incidental, or consequential damages, or for loss of data, progress, or Virtual Items. Nothing in these Terms limits liability that cannot be limited by law (such as liability for death or personal injury caused by negligence, fraud, or your mandatory statutory consumer rights).
These Terms are governed by the laws of Spain, without prejudice to the mandatory consumer-protection rights of the country where you live. If you are a consumer in the EU, you may also use the European Commission's Online Dispute Resolution platform at ec.europa.eu/consumers/odr.
We may update these Terms from time to time. We will update the "Last updated" date, and, where changes are material, provide reasonable notice within the Game or on this page. Continued use after changes take effect means you accept the updated Terms.
